GENERAL TERMS & CONDITIONS OF THE ONLINE SHOP /BAN/ General Conditions of the online shop specify the conditions of purchase and sale of products carried out by BAN / Online Gallery Space (hereinafter referred to as the supplier). General conditions of the online shop /BAN/ are in accordance with the Consumer Protection Law and international codes for e-business. The online shop /BAN/ is an information system designed for presenting and selling different products to users (the system). It is managed by BAN Online Gallery Space. A user is a person who uses the system, therefore the customer in the web shop /BAN/. Mutual obligations between the suppliers and customers are governed by these general conditions. By using the website the customer agrees to the terms of use. The online shop /BAN/ reserves the right to change the general conditions. The customer can use the content of the web page for personal use only. No part of the online shop /BAN/ should be used for commercial purposes. No third party is allowed to use the content of the web site for creating a public filing system or publish it in other media or in other places. The supplier reserves the right to change or delete any part of the online shop /BAN/ without notice. Each customer uses his or her own user name and password to log on. The password is secret and known only to the customer. The customer obtains the password by e-mail. The customer is obliged to ensure that only they will use the password or the person authorized to act on their behalf.

PAYMENT / In the online shop /BAN/ you can safely pay for the goods by PAYPAL. The supplier gives out a receipt, which is a warranty proof when making a valid complaint or asking for service intervention.

PRICES IN THE ONLINE SHOP / All prices in the online shop /BAN/ are in EUR and include VAT. We reserve the right to alter the prices. Prices clicked on by the customers while shopping are valid current prices. The values of VAT and postage costs are shown in the shopping basket, before the customer completes the order. The data from the shopping basket are valid until subject to cancellation.

THE PROCESS OF PURSHASING / Firstly, the customer needs to log on. In the catalogue of products the customer selects a product they want to buy. By clicking on the picture of the product or the magnifying glass the customer gains accurate information about a particular product, which is applicable till running out of stock. The customer chooses the color and quantity and adds a product in the online basket. While browsing the online store, products added to the shopping basket are clearly presented on the web page. Under the selected products the prices are listed along with the total cost of all selected articles. If the customer wishes to remove a particular product from the shopping basket, they should click on the “quantity box” and change the number of items in the basket and then click “recalculate”. If the customer wants to put a particular product in the basket, they should click on the desired product (in the left column) and add a product in the shopping basket. By clicking on “buy” the box with the customer’s data opens. Check if the information is correct. Select the method of payment and indicate that you agree to the terms and conditions. Click on the “continue” button. Please check all the information again. In this box the customer is shown complete costs of the purchase (the price of items and postage). If the customer wants to make alterations, they should click on the "correct information". Otherwise, click on "buy." In the window that opens, the customer enters the credit card information, and clicks "confirm". Please check the information again and click "confirm payment". It is confirmed if the payment has been successfully carried out. The confirmation of the order and payment will be notified through the customer’s e-mail address.

RIGHT TO CANCEL AND RETURNS / The customer may cancel their order up to 15 days after the customer has received their goods. The period can be made exceptionally longer if the costumer has not received with their goods the information about them, which is obligatory under the Consumer Protection Act. In this case, the customer can return the goods within 15 days upon receiving the necessary information, or, at the latest, within three months upon receiving the goods. It is sufficient if the customer mails the goods back within the above-mentioned time limits. Goods can be returned to the supplier within 30 days from the date when notifying the supplier about the cancellation of the order. Postal charges are paid by the customer. The customer must return the product in its original packaging. The product must be intact and in their quantity. If the customer applies for a refund, it is paid back to the customer though their bank account (therefore the customer should provide their bank account number). The refund is paid within 30 days of notifying the supplier about the cancellation or from the return of goods. Cash shall not be paid. The contract between the customer and the supplier is in the electronic form kept at the supplier’s offices. An individual contract is valid until the time of delivery of each item. The validity of the contract for purchasing certain goods is restricted to the time of delivery of goods. CANCELLING THE CONTRACT / The customer can cancel the orders without any additional cost within twenty-four hours from confirming the purchase. The cancellation is made only through e-mail shop (at) balkanartnow.com. It is necessary to provide the following information in the e-mail: 1. the message title: Cancelling orders; 2. the content of the message: a) the customer’s name and surname, address and the contract’s number (contract number is located in the title of the electronic message received upon the purchase of goods).

SECURITY / The supplier uses the appropriate technological and organizational means to protect the transmission and storage of personal data, orders and payments. The customer is solely responsible for accessing their system and protection of their data and passwords. The customer guarantees that all transmitted data is accurate and truthful. The customer is obliged to immediately inform the supplier if there are any changes concerning personal data. The supplier is not responsible for any damages caused by incorrect or false personal information provided by the customer.

RIGHT TO PRIVACY / The supplier is committed to long-term protection of personal data in accordance with the Personal Data Protection Act (Official Gazette RS, no. 94/2007). All the information obtained through the online shop /BAN/ will be used exclusively for sending bids, invoices and other necessary communications.

DELIVERY / Delivery charges are listed on the shop’s web pages. The goods will be dispatched not later than 5 working days after the confirmation of payment. The online shop operates 24 hours a day, every day of the year. The supplier receives the orders 24 hours a day and processes them within 5 working days. The processing of orders on a non working day is carried out on the next following working day. The supplier will endeavor to deliver goods to the customer as soon as possible. Generally, delivery can be expected within two weeks, although during busier periods please allow up to 21 working days. Wherever possible we try to dispatch as soon as an order is processed. You can be rest assured that your artwork will arrive safely. Not only do we independently insure every work of art we ship, we pack each piece by hand with ample protective measures. It is packed using styrofoam inserts and bubble wrap. The customer will be informed about the most likely time of delivery upon confirming the payment. The purchase contract will be stored at the supplier’s offices. On request, the customer may ask for a written copy of the contract through the following e-mail: shop (at) balkanartnow.com.

COMPLAINTS AND DISPUTES / The supplier respects the existing legislation on consumer protection. Appeals and complaints can be sent by e-mail to shop (at) balkanartnow.com. The supplier must confirm receiving the complaint within five working days, inform the customer about the duration of processing the complaint and keep the customer throughout the procedure up to date. The supplier will use its best efforts to resolve any disputes through agreement.
